General terms and conditions - Les Locations de la Méditerranée
I- Intellectual property :
The site www.leslocationsdelamediterranee.com belongs with full ownership to the company Les Locations de la Méditerranée, registered in Marseille Trade and Company Register under SIREN n°790575468, which headquarter is located 4 rue du Coteau, 13007 Marseille. As a consequence, all the components of the site (texts, pictures, etc) are the exclusive property of Les Locations de la Méditerranée Ltd and are protected by French Law on Copyright and Intellectual Property. Any extraction or use of the contents without being expressly authorized may incur the civil and or criminal liability of its author.

II- Owners and tenants personal data :
All personal data entrusted to us by our clients- last name, first name, address, mail, phone number and account number- are the exclusive property of Les Locations de la Méditerranée and will remain confidential in accordance with the French Data Protection Law and the free circulation of such data (see EU data protection directive 95/46/eu, published in the Official Journal 23/11/95). In contrast, we cannot be held responsible for the transmission of personal data from the tenants to organizations such as banks, insurance companies, etc. In accordance with this directive, our clients have at any time a right of access, rectification and opposition to all of their personal data. To use this right, just send us a mail indicationg your name and the desired change.

III- Rates :
All our prices are indicated without VAT (VAT not applicable, art 293B of the French General Tax Code, CGI). Prices are indicated in euros, and all amounts perceived are to be paid in euros as well. Our rates include the agency fees, as well as all charges (electricity, gas,water and internet subscription- only if the property is equipped with an internet access). If the rent is exclusive of charges, this will be mentioned in the ad.

IV- Booking conditions :
   IV.1- How to make a booking ?
Renting properties are considered booked when the deposit of 25% of the total renting price has been paid, the renting timetable checked and validated by Les Locations de la Méditerranée, and a confirmation sent by e-mail to the tenant, within 48 hours after the booking on our website.

The payment of the deposit can be made :
-by credit card on our website, via a secure system linked to the LCL Marseille Catalan 5 Rue Capitaine Dessemond, 13007 MARSEILLE. The booking will then be effective, providing the renting timetable has been updated by the owner.

-via Paypal- extra costs will be charged to the tenant, i.e 3.4%+ €0.25 per transaction.

-via postal money order, made payable to Les Locations de la Méditerranée, all costs being charged to the tenant.

- via bank transfer, on the bank account to the LCL Marseille Catalan 5 Rue Capitaine Dessemond, 13007 MARSEILLE. If you choose this means of payment, we will provide you with the account details.

-by French bank cheque, labelled to Les Locations de la Méditerranée, 4 rue du Coteau, 13007 Marseille. We advise you to send your mail by registered post with acknowledgement of receipt.

- By travelers cheque. We advise you to send your mail by registered post with acknowledgement of receipt.

- by holiday vouchers. We advise you to send your mail by registered post with acknowledgement of receipt.

In the case of a bank transfer, postal money order or a cheque, the booking will be considered effective only on payment of the balance. 72 hours later, without reception of payment, the property will be returned to renting on our website, and the booking will be suspended or cancelled in the case of new clients, without compensation of any sort. If the agency was to cancel the booking, the deposit if paid by credit card, would be refunded to the tenant, but no compensation could be claimed. For all means of payment, we commit ourselves to refund the deposit by cheque or bank transfer.

The options (see section IX- our services) selected by the tenant are to be paid with the settlement of the balance. Please note that the tenant is entitled to a 7 clear-day period to cancel the options without being required to pay any compensation or damages. The only exception is the cleaning service at the end of the stay which is mandatory and non negotiable, in order to guarantee our customers perfectly hygienic conditions.

Once the booking has been made, and the availability of the property confirmed by the owner, a confirmation is sent by e-mail to the tenant, together with a detailed invoice, including the balance to be settled and the amount of the security deposit to be trusted upon arrival. The balance and the options must be paid 20 days prior to arrival at the latest. If this wasn’t the case, Les Locations de La Méditerranée would cancel the booking and retain the deposit without any compensation. On the contrary, the balance could be claimed to the tenant if the property could not be re-rented. In the case of a booking less than 20 days prior to arrival, the balance is payable on our website by credit card, or by bank transfer to our account, following the payment of the deposit and prior to arrival. Tenants won’t be handed over the keys of the rented property without having paid the total renting price. A renting contract will be sent to the tenant on reception of the deposit and this contract must be signed and sent back to the estate agency head office : Les Locations de la Méditerranée, 4 rue du Coteau, 13007 Marseille.

   IV.2- The tourist tax
The tourist tax, if payable, is included in our rates. In some cases, especially when we put into contact a tenant and a landlord, it may not be included. In that case, the amount will be mentioned in the ad.

   IV.3- Establishing contact between landlords and tenants
We fully manage most of the properties offered on our website. We take care of the properties and of the tenant from the day of arrival to the day of departure. For some properties, we simply establish contact between landlords and tenants. Our job is then to market the property, draw up the renting contract, including the landlord’s details to allow the tenant to contact him and arrange an appointment, to cash the deposit and the balance. The landlord will take care of the tenants on the day of arrival and departure, manage possible problems, and will cash and pay out the security deposit. The options regarding cleaning and linen must be chosen before the signature of the contract and paid directly to the landlord on the day of arrival. Les Locations de La Méditerranée Ltd does not accept any liability regarding possible delays on arrival or departure times, problems of refund in case of damages to the rented property, accidents happening in the property, cleaning or linen problems. In none of these cases can the responsibility of Les Locations de la Méditerranée be committed.

V- Arrival and departure times and conditions :
   V.1- Arrival times :
When signing the contract, we will ask the tenants to let us know about their arrival time, so that an agent from Les Locations de la Méditerranée can be there to welcome them. We will ask the tenant to confirm the appointment one week prior to arrival. The arrival times are the following : 2pm-8pm from Monday to Saturday, except on Bank Holidays. Between 8pm and 11pm an additional charge of €30 will be invoiced. On Sundays and Bank Holidays, an additional charge of €30 will be invoiced. After 11pm, an additional charge of €60 will be invoiced. If you are late of more than 1 hour on the agreed arrival time, an additional charge of €30 will be invoiced, or directly deducted from the security deposit. You should warn us of any delay at least 3 hours prior to arrival. Beyond 24 hours without hearing from you, the booking will be suspended or even cancelled in case of new clients, without any possible compensation or refund of the deposit. If the agent from Les Locations de la Méditerranée is late of more than 1 hour on the agreed meeting time, €30 will be deducted from the total renting price. If the rented property is available before 2pm, the tenants can enter the property without any price supplement.

   V.2- Departure times :
Tenants can leave the property on the day of departure between 8am and 10am, 7/7, including Sundays and Bank Holidays, in which case an additional charge of €30 will be invoiced. If the tenant wishes to leave between 6am and 8am, with the agreement of Les Locations de La Méditerranée, and additional charge of €30 will be invoiced. If the tenant wishes to leave before 6am, an additional charge of €60 will be invoiced. In case of a delay of over an hour on the agreed departure time from the tenant, an additional charge called “administrative fee for late arrival or departure” of €30 will be invoiced or directly deducted from the security deposit. In case of a delay of over an hour over the agreed departure time from the agent, €30 will be refunded to the tenant.

VI- Arrivals and departures :
   VI.1- Arrivals :
On arrival of the tenant, a contradictory check-in inventory is performed in duplicate, signed both by the tenant and by the estate agent from Les Locations de La Méditerranée. One copy of this document is given to the tenant and the other is kept by the agency. A security deposit will be asked, as agreed in the contract. The amount of the deposit is calculated according to the surface of the property, the furniture and facilities and its location. It will be paid out at the end of the stay after the check-out inventory, within 10 days if the property is in good condition, and within 3 months if some repairs have to be undertaken. If the balance of the total renting price- including options- has been settled, the keys will be handed over to the tenant. If this is not the case, the tenant will have to settle the balance-including options- before getting the keys.

   VI.2- Departures :
At the end of the stay, on the date agreed when booking and confirmed when signing the contract- or the date agreed with Les Locations de La Méditerranée in the case of an extended stay- a check-out inventory is performed, with the tenant and an agent from Les Locations de La Méditerranée. One copy of this document is given to the tenant and the other is kept by the agency. The estate agent pays out the security deposit within 10 days if the property is in good condition, and for all means of payment (credit card, bank transfer, postal money order…). If there are any bank fees related to the refund of the deposit (postal money order, bank transfer to a foreign account..) these will be charged to the tenant. If any degradations are acknowledged, an administration fee of €35 for management of the repairs will be deducted directly from the security deposit. The repairs will be undertaken by Les Locations de La Méditerranée. If needs be, the invoices related to the repairs or replacement of damaged objects, will be sent to the tenant by post or mail. Their amount, as well as the fee for management of the repairs will be deducted directly from the security deposit, and this one will be refunded to the tenant by credit card, bank transfer or cheque. If the amount of the repairs is higher than the security deposit, the tenant commits to pay the overcharge under penalty of legal proceedings. The tenant hands over the keys to the estate agent and leaves the property. In the case of a delay deemed abusive due to the dysfunction incurred for Les Locations de La Méditerranée, and additional charge of €30 will be invoiced.

VII- Length of stay :
The minimal length of stay is 2 nights and the stay cannot exceed 90 days. Some of the properties we offer, in the absence of agreement with the landlord, are offered for a minimal length of stay of more than 2 nights, which is mentioned in the ad, and the booking is not possible via our website.
For a stay with a full amount of overnights lower than €350, an additional charge for administration fee is invoiced, in order to ensure the smooth conduct of arrival and departure formalities.
Total renting price between €0 and €269: €49 administration fee.
Total renting price between €270 and €350: €39 administration fee.
Total renting price over €350: no administration fee.

When booking a property on our website, the tenant will be asked to let us know his arrival and departure times. Those will be confirmed when signing the renting contract. If the tenant wishes to extend his stay, he must ask the agent from Les Locations de La Méditerranée. If the extension is possible and accepted, the tenant will have to pay for the extra cost. If the tenant wishes to shorten his stay, between the time of booking and before the signature of the contract, and on condition of having warned Les Locations de La Méditerranée at least 60 days prior to arrival by registered letter with acknowledgement of receipt, the deposit will be recalculated and overcharged costs will be refunded. If the tenant wishes to shorten his stay but warns Les Locations de La Méditerranée less than 60 days prior to arrival, the balance of vacant days will be refunded on condition that the property is re-rented for the period. An additional charge of €30 will then be invoiced for administration fees. If the property is not re-rented, the tenant will have to pay the balance of the total cost of the stay under penalty of legal proceedings.

VIII- Cancellation conditions :
Cancellation conditions on the part of the tenant : In all situations, the tenant must warn Les Locations de La Méditerranée as soon as possible, by registered letter with acknowledgement of receipt sent to : Les Locations de La Méditerranée, 4 rue du Coteau, 13007 Marseille. Cancellation conditions are as follows:
If the tenant cancels the booking more than 30 days prior to arrival, the deposit is lost except in the case of a subscription to a cancellation insurance at the time of booking, in which case the tenant is in charge of all the proceedings with the insurance. We don’t ask for the payment of the renting cost, nor any extra administrative fees.

If the tenant cancels the booking less than 30 days prior to arrival, the deposit is lost. If the tenant subscribed to a cancellation insurance, he must undertake all the proceedings with the insurance company to get a refund. If needs be, we will provide him with all the invoices. If the property is not re-rented in the meantime, the tenant will have to pay the entire cost of the stay. If the tenant was to refuse payment, Les Locations de La Méditerranée would undertake all legal proceedings.

If the tenant interrupts the stay before the agreed departure date, no refund or compensation whatsoever would be performed.

Cancellation conditions on the part of the agency :
Les Locations de La Méditerranée reserves the right to cancel a booking for situations which do not depend on their only will and constitute a case of force majeure such as a disaster in the property (fire, burglary, flood, etc).
If necessary the agency commits to find a replacement solution, by offering the tenant another similar property, available at the same period, at no additional charge. If no solution is found, the renting cost will be fully refunded to the tenant, as well as a compensation amounting to the 25% of the deposit paid on top.
Lack of settlement of the balance of the renting cost on time (20 days prior to arrival), of the deposit, options administration fees, day use or extra costs for arrival and departure times constitute serious grounds resulting in termination as of right of the contract to the benefit of Les Locations de La Méditerranée, who will keep the deposit and will be allowed to claim all the amounts owed, damages as well as late penalty fees.

IX- Insurances :
Renting insurance : when signing the renting contract, the tenant will have an interest to include in the file a house insurance for the rented property or ask his insurance company to send by mail an insurance certificate. In most cases it is included in the “holiday extension” of the main residence insurance. If that was not the case, you can find on our website a link to Aldar insurance company which offers that service. If the tenant chooses not to insured the rented property against rental risks, he acknowledges that he has been warned of the consequences by Les Locations de La Méditerranée. Indeed, without any insurance, and in the case of a disaster happening during the stay, the tenant will have to reimburse all damages to the property and its surroundings to the landlord and to the insurance of the rented property, and he will be liable for the damages if a legal action must be undertaken. Cancellation insurance : on our website, you can find a link to Aldar insurance company. On his part, the landlord must insure the property against rental risks that could be caused by the tenant. The latter commits to warn the landlord within 24 hours for any disaster in the renting property, its outbuildings and equipment.

X- Our services :
Here are the services we offer as options :
A set of bed linen for double bed including one fitted sheet, one flat sheet or duvet cover and two pillowcases : €12.
This can be changed to the goodwill of the tenant against payment. The cleaning of the bed linen is not charged to the tenant.

A set of bed linen for single bed including one fitted sheet, one flat sheet or duvet cover and one pillowcase: €10
This can be changed to the goodwill of the tenant against payment. The cleaning of the bed linen is not charged to the tenant.

A set of bath linen including one bath towel : €6 per person.
A bathmat is provided with the set of bath linen, limited to one bathmat per renting. This can be changed to the goodwill of the tenant against payment. The cleaning of the bath linen is not charged to the tenant.

Grocery shopping on arrival : For a fee of €30 on top of the groceries price. The estate agent will contact the tenant to get to know what to buy. The grocery shopping only includes what is needed for dinner on the day of arrival and for breakfast the following morning.

Lending of a baby’s cot : €15

Lending of a high chair or booster : €10

Lending of a baby kit including a cot and a highchair or booster : €20.

When one of those services is required by the tenant after arrival, an additional charge of €30 is invoiced to cover the travel expense. If that amount is not paid by the tenant, Les Locations de La Méditerranée Ltd is entitled to deduct it from the deposit. If an item is damaged, it will be replaced at the tenant’s expense, and the cost can be deducted from the deposit. All objects or linens are guaranteed in good condition, and must be returned in the same state as found upon arrival. In the case where a set of bed linen or bath linen is returned spoilt or stained, we reserve the right to invoice the purchase price and to add an additional charge of €35 for management of the repairs and to cover the travel expenses incurred to buy the items back.

Day use : enants can stay in the rented property until 7pm, providing it is not rented to other people, for a fee of 20% of the overnight rate. For the properties equipped with a landline, all the costs are the tenant’s responsibility if the numbers called are not included in the operator’s freephone numbers.

Final cleaning can be done by the tenant with the cleaning kit available in each rental. After each location Les Locations de la Méditerranée will check the cleaning during the inventory of exit. Les Locations de la Méditerranée will be allowed to invoice the client some cleaning hour for inadequate cleaning at 25 € per hour ((each hour begin will be paid) However, we propose a cleaning service at the end of you stay if the tenant do not want to do it at 25/hour.

Our rates are as follows :
-up to 30m² : €25
- from 31m² to 40m² : €35
- from 41m² to 50m² : €45
- from 51m² to 70m² : €55
-from 71m² to 90m² : €75
- from 91m² to 100m² : €100
- from 101m² to 120m² : €115
- from 120m² : €135

To be defined on a case by case basis. These rates are given for information. They can vary according to the properties, their location, or the travel expenses incurred. The rate of end-of-stay cleaning is mentioned in the ad for each property. When we simply establish a connection between the landlord and the tenant, cleaning may not be mandatory and can be done by the tenant. Cleaning can be performed as often as the tenant requires, and the rate in this case is €25,00/hour. The properties are clean on arrival and must be returned in the same state of cleanliness, including if the tenant does the cleaning himself. In case of a rough cleaning, Les Locations de La Méditerranée reserves the right to have the property cleaned again and the cost will be deducted from the security deposit. It is to be noted that the tenant is entitled to a 7 clear-day withdrawal period starting on the day when he confirms the selected options. This withdrawal period is valid if and only if the selected service has not started at the time of cancellation. If the withdrawal period ends on a Saturday, Sunday or Bank Holiday, it is extended to the following working day.

XI- Renting capacity :
All our properties are dedicated to welcome a limited number of people, mentioned on the ad on our website www.leslocationsdelamediterranee.com and confirmed in the renting contract. The tenant can come with as many people as he wishes on condition that this does not exceed the maximum capacity of the rented property. This will not incur any charge in the renting price. If the number of people in the property exceeds the maximum capacity, Les Locations de La Méditerranée reserves the right to cancel the booking, without any possible damages or compensation whatsoever. A solution can be found to replace the rented property by another one, with a more important capacity, on condition that such a property is available on our website at that period.

XII- Complaints, disasters, deteriorations :
The renting properties offered are all furnished and equipped with kitchen ustensils, dishes, glassware, blankets and pillows, as indicated in the entry inventory which is given to the tenant on arrival. Les Locations de La Méditerranée reserves the right to request from the tenant, on departure, the replacement of any deteriorated item or equipment, as well as the replacement of abnormally worn out objects. The tenant will also be required to pay for the cleaning of blankets returned dirty, and a compensation will be asked for all degradations regarding curtains, wallpapers, ceilings, carpets, carpeting, windows, bedding, etc. All complaints regarding the rented property must be done within 24 hours following the entry into the property, first informally over the phone to the agent from Les Locations de La Méditerranée, and then by registered mail with acknowledgement of receipt sent to : Les Locations de La Méditerranée, 4 rue du Coteau, 13007 Marseille. All documents related to the complaint must be enclosed In the mail. However, the estate agency cannot be held responsible for all troubles relating to electricity, gas, water, internet and phone. In case of deterioration in the property, the common parts or the outbuildings, the tenant will be asked to do the repairs or to replace any spoilt object at his expense. If any deterioration is acknowledged during the exit inventory, Les Locations de La Méditerranée will undertake the necessary repairs and deduct the cost from the security deposit. The balance will be paid out to the tenant within 3 months. If the cost of the repairs exceeds the amount of the security deposit, all the extra costs remain the responsibility of the tenant, and must be quickly settled under penalty of legal proceedings. If deteriorations are acknowledged, administration fees of €35 will be deducted from the security deposit for management of the repairs. In the event of a disaster, Les Locations de la Méditerranée must be warned as soon as possible in order to be able to act accordingly with the landlord’s agreement. If the disaster is so important that it requires the tenant’s departure, and is not his responsibility, the tenant will be relocated in a similar property, providing such a property is available at that period. If that was not the case, all the overcharged costs would be refunded to the tenant within the month following the departure, if and only if the disaster is not the tenant’s responsibility.

XIII- Keys :
One or two set of keys are handed over to the tenant on arrival. They must be returned during the exit inventory. If one or several keys are lost or deteriorated, Les Locations de La Méditerranée will get new keys and the cost will be deducted from the security deposit. Additional charges for management of the repairs of €35 will also be invoiced to the tenant. The agency possesses a spare set of keys which can be used to open the door to the tenant in case of loss or deterioration of the keys. In that case, an additional charge of €35 will be invoiced for the travel expenses and inconvenience caused. If this was to happen between 10 pm and 5am, a premium of €40 will be invoiced on top. These amounts can be deducted directly from the security deposit.

XIV- Forgotten items :
If some items are forgotten in the property, Les Locations de La Méditerranée commits, after agreeing with the tenant, to send them back by postal service, all fees incurred remaining the responsibility of the tenant (shipping costs, wrapping, etc). These fees can be deducted directly from the security deposit.

XV- Swimming pools :
Some properties- whether villas or apartments- come with a swimming-pool. Les Locations de La Méditerranée ensures that they comply with the 3/01/2003 law and make sure that they meet all safety standards. However, when the maintenance is the responsibility of the condominium, Les Locations de La Méditerranée cannot be held responsible for any malfunctioning. Only residents can access the swimming-pool s and the responsibility for supervision fully belongs to the tenant. Les Locations de La Méditerranée cannot be held responsible for incidents or accidents that may occur, especially to minor children, who must be accompanied by an adult.

XVI- Tenants’ obligations :
The renting properties offered by Les Locations de La Méditerranée are for private use, in the frame of a touristic or business trip. It is strictly forbidden to divert them to commercial, professional or craft ends. The same applies to the organization of events such as weddings, seminars, etc which requires prior approval from both Les Locations de La Méditerranée and the landlord of the property, and are submitted to administration fees of €30. During the stay, the tenant must behave like a diligent administrator, meaning he must respect both the property and the neighborhood. Any nuisance due to noise or inappropriate behavior can lead to a cancellation of the booking without any damages or compensation. The agency cannot be held responsible for nuisance caused by the tenant. Les Locations de La Méditerranée reserves the right to ask a tenant to leave in the case where his behavior could be deemed shocking for the neighborhood, without any compensation or damages. The tenant also undertakes to respect the condominium regulations. If such regulations exist they are enclosed with the inventory on entry. Properties must be returned in the same condition as they were on arrival, meaning clean and tidy with smoothly running facilities. All lost or deteriorated object must be repaired or replaced- if the tenant doesn’t act on his own, the corresponding amount will be deducted from the security deposit. It is forbidden to flush into the toilets or any other pipe objects that could block them. If such a situation was to happen, all replacement costs would be charged to the tenant and deducted from the security deposit. Individuals, either minor or adults under guardianship cannot be accepted into the properties if they are not accompanied by a responsible adult all along the stay. The properties offered for renting might present some hazards such as terraces, mezzanines, pools, stairs, etc. Children or adults under guardianship are placed under the responsibility of their parents or legal guardians. Les Locations de La Méditerranée cannot be held responsible for any incident or accident. The tenant commits to respect the maximum capacity of the rented properties, or Les Locations de La Méditerranée reserves the right to cancel the booking and ask the tenant to leave the property without any damages or compensation. It is strictly forbidden to smoke in the properties. If the tenant was to violate this ban, and if a smell of tobacco was detected during the exit inventory, the tenant would be charged with administration fees of €35 for management of the repairs, and for all the necessary expenses to suppress the smell and dry-cleaning. Pets are not allowed in the properties. If the presence of pets is acknowledged during the exit inventory (hairs, etc) the tenants will be charged administration fees of €35 as well as the expenses to clean the property. Les Locations de La Méditerranée cannot be held responsible for thefts, degradations and neighborhood nuisances happening during the stay.

XVII- The duties of Les Locations de La Méditerranée :
Les Locations de La Méditerranée commits to offer the tenants carefully selected properties, located in attractive places in the Var, in Marseille or else on the Côte Bleue. We are at our customers’s disposal to advise and guide them regarding places to visit, or leisure activities. Les Locations de La Méditerranée undertakes to offer clean and tidy properties, with smoothly running facilities (regardless of any subscription such as electricity, gas, water, etc which are not of our making). If the tenant chooses the options for bed and bath linens, Les Locations de La Méditerranée commits to provide clean linens. We also undertake to take into consideration and to deal efficiently with all complaints from the tenants. As we have a spare set of keys, we will be able to enter the property to deal with any problem without disturbing the tenants, at a chosen moment. We commit not to enter the rented properties at any moment, except for entry and exit inventories, or to perform any necessary repairs. At the end of the stay, tenants are invited to leave their opinions and comments on our website www.leslocationsdelamediterranee.com. We reserve the right to withdraw a comment presenting a discriminatory, rude or insulting character. Les Locations de La Méditerranée commits to never discriminate whatsoever regarding landlords or owners. Les Locations de La Méditerranée are dedicated to welcome and serve its customers, whether landlords or owners, in an efficient and professional way.
